Special Protections interrogates the place of indigenous iconography within the liberal Australian Commonwealth. It seeks to determine if Aboriginal iconography, that being expressions of folklore imbued with a spiritual dimension, should be protected beyond the scope of the Copyright Act 1968 (Cth). Using this intellectual framework, this book comes to an ethical conclusion through the theology and political writings of John Locke. This ethical conclusion is given practical legal standing by considering it in regards to the Copyright Act 1968 (Cth) and state-level laws, eg, Equal Opportunity Act 1995 (Vic), Racial Vilification Act 1996 (SA), Aboriginal Heritage Act 2006 (Vic).

About the Author:

Aron Ping D'Souza is a legal scholar and political economist. His first book The Art of Time, an application of information system theory to moving images, was published in 2006. Mr. D'Souza is currently writing a Ph.D. at the University of Melbourne entitled A General Theory of Communal Property. Previously, he was Executive Director of the Australian International Film Festival. He is the editor of the Journal Jurisprudence, a scholarly periodical on legal philosophy, and teaches in political economy at the University of Melbourne. A frequent contributor to newspapers and other media outlets, his work has appeared in publications such as The Times of London, The Gulf Times, The Australian, The Age and The Herald Sun.
