First edition, first printing (May). --- An African-American labor organizer, Herndon arrested and convicted of insurrection after attempting to organize Black and white industrial workers in Atlanta, Georgia, in 1932. The prosecution case rested heavily on Herndon's possession of "communist literature." Herndon was defended by the International Labor Defense, the legal arm of the Communist Party of America. Over a 5-year period, Herndon's case twice reached the United States Supreme Court, which ruled that Georgia's insurrection law was unconstitutional, as it violated First Amendment rights of free speech and assembly. He was freed in 1935. A fragile publication of a cause célèbre that drew international outrage.

Damon, Anna. Victory, Decision of the United States Supreme Court in the Case of Angelo Herndon, April 1937. Chicago: State of Illinois, 1937. Measures 8.5" x 6.5". 30 pages. In the introduction, Damon writes "The decision will be a spur to the fight to wipe out the repressive laws against labor and political groups which still disgrace the statute-books of thirty-four states. It will be a spur to greater victories in the fight to open other prison doors. Herndon is free.all other labor and political prisoners, next!" Angelo Herndon was an African American labor organizer arrested and convicted of insurrection after working to organize black and white industrial workers in Atlanta in 1932. Close to 1,000 black and white unemployed workers united across color lines to demonstrate at the federal courthouse, alarming officials who began monitoring known leaders including Herndon. The case against him rested on "communist literature" found in Herndon's hotel room. He spent six months in prison before getting out on bail and was found guilty by an all-white jury in 1933. His case twice reached the United States Supreme Court which ruled Georgia's insurrection law unconstitutional for violating free speech and assembly. Light soiling on front cover does not affect text. Overall good condition.

Condizione: Near Fine. A pair of items relating to Angelo Herndon and the International Labor Defense's efforts on behalf of the Scottsboro Boys in 1936 in Chicago. The flier advertises an appearance by Herndon at the Metropolitan Community Church at 4100 South Parkway. The flier urges readers to send protest telegrams to President Roosevelt and Governor Bibb Graves of Alabama demanding the Scottsboro Boys' release. It adds" The United Action of all people, black and white will stop Jim Crowism, lynching and frame-up of innocent workers." The second item, a ticket for a separate event involving Herndon on Sept 14th, where he appeared alongside Clarence Norris and an unidentified speaker with the last name Moore at a mass meeting. The ticket gives free admission to "Unemployed Marcher to Neighborhood." An interesting pair of items documenting Herndon's activity in Chicago during the period and the efforts taken by the International Labor Defense on the part of the Scottsboro Boys. Flier measuring 8 ½ x 11 ½ inches, with ticket measuring 4 x 2 inches. Some light wear and toning, near fine.

Inscribed by Herndon on the front fly: "To My dear comrade Kenneth Fitzgerald. Comradely regards, Angelo Herndon May 16, 1937." Fitzgerald was a member of the Communist Party's central and legislative committees and a contributor to *The Daily Worker*, who was named during the HUAC hearings.
