Esta institución presenta un fundamento y características similares a la de los daños punitivos del Derecho anglosajón, pudiendo suponerse una relación genética entre ambas. En el ámbito continental, la multa privada por las lesiones dolosas está claramente presente en Derecho común y desaparece en el proceso de la codificación, aunque quizás, de manera más o menos subrepticia, reaparece en el moderno Derecho español, bien por vía legislativa, o bien, más típicamente, por vía doctrinal y jurisprudencial, por lo que el recelo de los autores a aceptar en nuestro Derecho (español y europeo) la incorporación de Daños punitivos no estaría justificada.
