In order to understand this issue in context, a comparitive approach looking at the American legislative framework has been adopted. The position of international law on the point has also been examined at considerable length. The authors have not only looked at the issue solely from the legal perspective but also examined the sociological undercurrents underlying the same and suggested a policy framework that can help achieve gender equality in this sphere, which, as the authors argue, also serves as an effective medium of women empowerment in general.
