It is intended for two groups of readers: students of history, social sciences, and comparative law on the one hand, and on the other, students of Arabic who might wish to embark upon this particularly important and attractive branch of Islamic studies. Islamic law provides us with a remarkable example of the possibilities of legal thought and of human thought in general, and with a key to understanding the essence of one of the great world religions. This book is concerned with the unique historical phenomenon of Islamic law as such, and not with the contemporary laws of those countries in the Near East and else-where where Muslims live. I am writing as a Student of Islam and of that manifestation of Islam which is Islamic law, and not as a lawyer, or a comparative lawyer, or a sociologist. Nevertheless, as a Student of the history of Islam, I have tried to refer the development of Islamic law to the development of Islamic society, and to integrate the historical and systematic sections of this book as far as the present State of our knowledge allows. In order to keep my account within reasonable limits, I have had to restrict myself to the history of Islamic law within the orthodox or Sunni Community, leaving aside the separate developments of Shiite and Ibädi law, and to choose, in the systematic section, the doctrine of one of the orthodox schools of law, the Hanaf I; I have, however, not hesitated to extend the bibliographies to all orthodox schools and to Shiite and Ibädi law. The bibliography forms an essential part of this book; it is intended for both groups of its potential readers, but I have not aimed at bibliographical completeness. In particular, I have omitted those publications which are now of historical interest only, or do not add substantially to what has been said in the text, or fall short of present scholarly Standards . (Preface; Schacht) // Das vorliegende Buch ist eine Neubearbeitung meiner im Oktober 1903 (in holländischer Sprache) erschienenen, jetzt schon seit einigen Jahren vergriffenen "Handleiding tot de kennis van de Mohammedaansche Wet volgens de leer der Sjäfiitische school" und bietet wie diese eine gedrängte, systematische Darstellung derjenigen Vorschriften des islamischen Gesetzes, die am meisten praktische Bedeutung haben für das muslimische Leben, nebst den erforderlichen historisch-kritischen Erläuterungen und einer allgemeinen Einleitung über den Fikh und die Quellen dieser Wissenschaft (die sogen. Usül al-Fikh). Sowohl das Ritual und der Kultus, als auch das Familienrecht, die Rechtspflege, die Organisation der muslimischen Gemeinde und ihr Verhältnis zu den Bekennern anderer Religionen sind berücksichtigt und nach den tonangebenden schäficitischen Kompendien auseinandergesetzt. Die Lehre der Schäficiten ist darum gewählt, weil alle Muslime in Niederländisch-Indien zu dieser Schule gehören. Von einer Erörterung der abweichenden Lehren anderer Fikh-Schulen musste in den meisten Fällen abgesehen werden. Man behalte also im Auge, dass in diesem Buche mit Ausdrücken wie "das Gesetz befiehlt", "das Gesetz verbietet" stets gemeint ist "das Gesetz nach schäfiditischer Auffassung". Eine kurze Übersicht über die Hauptunterschiede zwischen der schäfiditischen, hanafitischen und mälikitischen Lehre betreffend Ehe-, Familien-, Strafrecht u. a. findet man in dem Artikel "canon law [Muhammedan]" (Vorwort; Juynboll) Sprache: Deutsch Gewicht in Gramm: 1500.
