This case differs from that of Tift and that of China and Japan Trading Company in the respect that the illegality of the method resorted to to increase the rates has been already judicially declared. Upon a statement of facts submitted to the Department of Justice last May, and subsequently embodied in a complaint, the Court held, at least for the purposes of an injunction, the agreement to be viola tive of the provisions and prohibitions of the anti-trust Act. Per haps it is still more important that the entering into such agreement, or combination, was a violation of injunctions granted by the Circuit Court in 1898 and 1899.
