Le fait que des juristes éminents repoussent et combattent cette théorie du domaine public tel, entre autres, en Allemagne, Jellinik ne l'empêche pas de trouver souvent encore crédit dans l'administration et la jurisprudence. Le domaine public dans lequel, outre les routes, les chemins et les cours d'eau, on compte aussi les côtes, les ouvrages fortifiés, les cimetières, les plantations publiques et les choses de ce genre ne doit, d'après cette théorie, être vendu ni soustrait à l'usage commun. Car la chose publique doit avant tout garder sa destination. Le droit privé, indifférent envers la chose publique, doit, justement à cause de cette indifférence, être exclu. Il est remplacé par un ordre juri dique dans lequel, essentiellement, l'autorité qui est à la tête de la chose publique et qui en a le soin conserve le droit de régler tout de la façon compatible avec le but à atteindre (mayer, Deutsches Verwaltungsrecht [droit administratif allemand)] Mais une chose publique peut n'être qu'une servitude de droit public, traitée cependant comme domaine public. Les routes et les chemins sont choses publiques, mais le terrain sur lequel ces routes sont construites peut être en même temps propriété privée et, en cette qualité, être soumis à la juridiction de droit privé.
