Or l'hypothèque étant un démembrement du droit de propriété, (saprà, n° celui qui constitue une hypothèque fait acte d'aliéna tion, en ce qu'il confère au créancier le droit réel de suite sur l'im meuble aux mains des tiers, et le droit de faire vendre l'immeuble pour être payé. Donc, la capacité 'a l'effet de constituer hypothèque est sub ordonnée à une double condition il faut que le constituant soit pro priétaire de la chose hypothéquée, et, de plus, qu'il ait la faculté d'en disposer.
