It will be perceived that the Editor of the last English edition of Chitty on Contracts, published the present year, has made copious additions to the labors of his predecessor, and has rib-arranged various portions of the text, as well as of the Index.

These additions, and this te-arrangement have rendered necessary corresponding additions and changes in the notes to this, the fifth American edition. The purpose of the American Editor has been to meet the necessities of the case by sup plying new Notes, where required, adding to former Notes, where that seemed sufficient, and in all cases making reference to all the important decisions promulgated in this country since the publication of the American edition of 1839, and before this edition went to press. The editor has also referred to the new treatises and new editions of former treatises published in this country, touching the various topics discussed in this volume. This has caused a great increase in the amount of the Amer ican notes in this fifth edition. This fact is stated because it will. Not appear by the pages, or by the usual marks of dis tinction, between former and later notes.

It will be seen that frequent reference has been made to several articles on the subject of Contracts, which have lately been published in the American Jurist, understood to have been written by Theron Metcalf, Esq. Allusion is made to this matter, not to offer an apology for referring to the Jurist.
