Observez, 1° que la disposition par l'effet de laquelle les enfans du mariage sont substitués vulgaireinent au donataire, est fondée sur une simple présomption de la volonté du donateur; mais que cette présomption peut être détruite par' une volonté contraire. Si donc le dona teur a stipulé expressément que l'institution serait cadu que eu cas de prédécès du donataire soit qu'il y ait enfans, ou non, du mariage la clause est valable et la substi tution n'aura pas lieu au profit des enfans; car puisque le donateur peut, même dans le cas d'une donation entre vifs, qui saisit le donataire, stipuler le droit de retour pour le cas du prédécès du donataire seul à plus forte raison peut - il stipuler pour ce même cas la caducité de l'institution contractuelle.
