Décrété le 4 pluviôse an XII (24 janvier promulgué le 14 (4 février) preliminaires.
Idées générales. Le législateur doit s'occuper de tous les biens pour régler les droits que les personnes peuvent avoir sur eux. Mais il lui serait matériellement impossible de prendre un a un les différents cas particuliers à réglementer il devra donc distinguer un certain nombre de catégories de biens; de cette maniere il pourra dire plus tard en termes beaucoup plus généraux La règle posée s'applique à telle catégorie de biens toute entière et une autre règle à telle autre. Il lui faudra seulement bien déterminer, par des définitions précises, quels biens rentrent dans chaque catégorie.
En somme, il s'agit là d'une question de commodité et d'exposition pour le rédacteur d'un Code; on ne peut donc pas dire que le droit naturel lui trace sur ce point sa ligne de conduite. La distinction des biens-n'a, du reste, d'importance qu'en ce qui concerne les règles qui plus loin seront édictées par les diverses catégories distinguées ici. Une seule chose est anoter, c'est que logiquement le législateur ne doit admettre de distinctions des biens que celles qui dérivent de leur nature matérielle.
