Excerpt from The Principles of the Law Relating to the Discharge of Contracts
A contract may be discharged in the same way that it was made, that is, by the mutual agreement of the parties. This new agreement, like every other simple contract, must be supported by a consideration. It may expressly rescind the old contract; it may alter some of its terms, leaving those which remain unchanged; it may be an entirely new and independent contract, which is so far inconsistent with the Old one that they could not subsist together, in which case the old con tract is impliedly discharged; or it may change the parties to the original agreement, without affecting the manner of its performance.
