Excerpt from The Law and Practice in Proceedings Supplementary to Execution: Under the New York Code; With Forms
The creditor also sued out an injunction against the de fendant to prevent him from disposing of his property. This injunction was generally obtained and served with the subpoena. The return of the execution unsatisfied presupposed that if the debtor had any property it would be misapplied; and therefore the complainant was entitled to an injunction in the first instance. Bloodgood O. Clark, 4 Id, 577.
