All sorts of things movable wmch may attend a man's person wherever he goes (Blk. b. 2, c. 24). 2. What is property? Strictly speaking, property is the right to own, possess, enjoy, and dispose of things, either real or personal, but in its usual sense it embraces or is applied to all those things in which one may have a right and interest to the exclusion of others (Schouler, sec. 2; Smith, sec. 1; Darlington, p. 7). 3. What is to be understood by the term exclusive right? Where one holds a thing, either real or personal, to himself with the sole power of possession, enjoyment, and disposition he is said to have an exclusive or absolute right; this right may, however, be vested in one or more persons, as in land, by the entireties, coparcenary, joint tenancy or tenancy in common, and, in things personal, part ownership, partnership, and coownership. 4. What is the distinction between possession of a thing and property in the thing? Possession is not ownership, although prima facie one having possession has property; nor is property prima facie an evidence of the right of possession, as the possession may be in one, the right of possession in another, and the right of property in a third; exclusive right is where all three--possession, right of possession, and right of property--are vested in one person (Sch. 8; Smith, 1). $. What is the general division of personal property? Into goods and chattels; the latter term embracing all classes of things, movable or immovable, which are less than a freehold, while the former does not include animals or chattels real (2 Kent Com. 342; 2 Blk. 385; Dar. 2). 6.
