We are sensible that the difficulty of procuring good translations will be great; but we believe that the' means at the disposal of your Lordship in Council are sufficient to overcome every difficulty; and we are con-fident that your Lordship in Council will not grudge any-thing that may be necessary for the purpose of enabling the, people who are placed under your care to know what that law is according to which they are required to live. No argument that has been brought to our notice has satisfied us that it would be desirable wholly to dispense with this punishment. But. we are convinced that it ought to be very sparingly inflicted, and we propose to employ it only in cases where either murder or the highest offence against the State has been committed. We are not apprehensive that we shall be thought by many persons to have resorted too frequently to capital punishment; but we think it probable that many, even of those who condemn the English statute book as sanguinary, may think that our code errs on the other side. They may be of opinion that gang-robbery, the cruel mutilation of the person, and possibly Eape, ought to be punished with death.
