Ultimately it will I believe he found best to leave each private suit as much as possible to the uiri boni arbitratus acting authorita tively and publicly, whether he be called judge or arbitrator. Let the preparatory stages be under his control: let him order the proceedings as in the particular case may be best calculated to bring the issues out clearly: let all witnesses be examined who can throw light on the matter, whether the parties call them or not: let him stop the inquiry whenever it is being carried, even by the parties' consent, to an unreasonable length. It is pessimi exempli to have litigation run on, till the cost in time and money to the public and the parties is out of proportion to the attainable object of the suit.

Paperback. Condizione: New. Print on Demand. This book, a fascinating compilation of extracts from foundational legal texts compiled by order of Emperor Justinian, provides a glimpse into the origins of Western legal systems. The Digest organizes a vast body of legal thought and practice, bringing together the writings of renowned jurists from ancient Rome. Notable for its detailed examination of Roman law, including the concept of usufruct (a life interest in the property of another), it offers a comprehensive view of legal principles and their application in various contexts. The author's juxtaposition of extracts with their originals further highlights the transformative role Justinian's revision played in shaping legal thought. This book is an invaluable resource for anyone interested in the history and development of law, offering a profound understanding of the Roman legal system and its enduring influence on contemporary legal frameworks. This book is a reproduction of an important historical work, digitally reconstructed using state-of-the-art technology to preserve the original format.
