This volume deals with the major hurdle that all students must face - examinations. To overcome this barrier, it is important that the exam process is fully understood by students, and that the techniques used by successful examinees are thoroughly mastered. The book demonstrates how good students can do themselves justice in examinations by using the knowledge that they have acquired to full effect. The authors suggest ways in which legal arguments can be marshalled, and identifies methods by which both essay and problem questions can be tackled. Examples are drawn from the core subjects of contract, criminal law, public law and the law of torts, although the techniques illustrated can be applied to many other areas of the law. Introduction: exam objectives; types of exam questions. Part 1 Problem questions: criminal law - identifying the legal issues, structuring your answer, getting the balance right, analyzing the rules of law, applying the law to the facts, writing style; the law of torts - tackling a problem question on the tort of negligence, occupiers' liability and the Animals Act 1971, "Rylands v Fletcher"/nuisance/negligence; the law of contract - formation, exemption clauses, misrepresentation and (some) mistake, mistake and (some) misrepresentation; public law - constitutional law, civil liberties, judicial review. Part 2 Essay questions: essay questions - gathering the appropriate material, formulating your ideas, dissecting the question, structuring and presenting your material effectively.
