A claim form is not a judgment. Nothing has been decided, and the only thing that turns this into a judgment is silence.
An envelope arrives from a county court business centre about an old credit card, and it looks like the end of something. It is the beginning. No judge has read anything, nothing is on your credit file, and there is a form in the same envelope with about six fields on it that almost nobody fills in.
That form is the acknowledgement of service. Filing it takes two minutes, admits nothing, and under rule 15.4 it turns your fourteen days into twenty-eight. Rule 15.5 lets you and the claimant agree twenty-eight days more, with no fee and no judge. So the fortnight you think you have is really up to eight weeks.
This book is the whole process in plain English, for England and Wales.
How to work out the real deadline, which is not the day the envelope arrived and not the issue date either.
What the claimant actually has to prove, and what they had to do before they sued.
How to demand the agreement, the default notice, the statement of account and the assignment, using the £1 statutory request and CPR 31.14, and how to read what comes back.
The defences that are real, set out with the rule numbers, and the ones sold on forums that are not.
Why defending is not the financial risk you fear: on the small claims track the court may not order you to pay the other side's legal costs.
And if the debt is yours, how to admit it in the way that costs least, including the regulation that removes a county court judgment from the public register entirely if it is paid within one month of judgment. Not marked satisfied. Removed.
It is honest about the odds. Most of these debts are genuinely owed, "no wet signature" has not worked since 2009, and the leading case on limitation went against the debtor. What this book will not let happen is the outcome being decided by a deadline you missed.
Nothing to buy. No firm to hire. Free regulated debt advice named, with what each service can actually do.
