Riassunto

The imperatives of sovereignty, human rights and national security very often pull in different directions, yet the relations between these three different notions are considerably more subtle than those of simple opposition. Rather, their interaction may at times be contradictory, at others tense, and at others even complementary. This collection presents an analysis of the irreducible dilemmas posed by the foundational challenges of sovereignty, human rights and security, not merely in terms of the formal doctrine of their disciplines, but also of the manner in which they can be configured in order to achieve persuasive legitimacy as to both methods and results. The chapters in this volume represent an attempt to face up to these dilemmas in all of their complexity, and to suggest ways in which they can be confronted productively both in the abstract and in the concrete circumstances of particular cases.

Philip Alston is John Norton Pomeroy Professor at NYU Law School and Chair of the NYU Center for Human Rights and Global Justice. Since 2004 he has been UN Special Rapporteur on extrajudicial, summary or arbitrary executions.

Jos� E. Alvarez is Hamilton Fish Professor of International Law and Diplomacy and Director of the Center on Global Legal Problems, at Columbia University Law School. He is also President of the American Society of International Law.

Nathaniel Berman teaches public international law, European Union law, international trade law, and human rights at Brooklyn Law School. He previously taught at Northeastern University School of Law.

Richard Bilder is Foley & Lardner-Bascom Emeritus Professor of Law at the University of Wisconsin-Madison. He previously served as an attorney in the Office of the Legal Adviser at the U.S. Department of State.

Nehal Bhuta is Assistant Professor of Law at the University of Toronto. He has previously worked with the International Justice Program of Human Rights Watch and as a consultant with the International Center for Transitional Justice in New York.

Olivier Corten has a doctorate in law, is Professor at the Universit� Libre de Bruxelles, and is co-Director of its Centre de droit international et de sociologie appliqu�e au droit international. He is also Editor of the Revue belge de droit international.

Euan MacDonald has a Doctorate from the European University Institute in Florence and is currently a Research Officer on the Global Administrative Law project of New York University's Institute for International Law and Justice. He was previously a Visiting Fellow on the Programme for the Study of International Organizations at the Graduate Institute for International Studies in Geneva

Anthea Roberts is an Associate at Debevoise and Plimpton in London where she is a member of the firm's International Dispute Resolution Group. She has worked on a variety of public international law and alien tort claim cases and as counsel in several international arbitrations.

H�l�ne Ruiz Fabri is Professor of International Law at the University of Paris I - Panth�on Sorbonne, and Director of the Paris Institute of Comparative Studies. Since 2006 she has been the President of the European Society of International Law.

Il periodo di recesso scade dopo 14 giorni dal giorno in cui

tu acquisisci, o un terzo designato diverso dal vettore e da te acquisisce, il possesso fisico dell'ultimo bene o l'ultimo lotto o pezzo.

Per esercitare il diritto di recesso, sei tenuto a informare Jenhams Books, 1 Invergowrie House, George Pirie Way, DD2 1UA, Dundee, United Kingdom, della tua decisione di recedere dal presente contratto tramite una dichiarazione esplicita (ad esempio lettera inviata per posta, fax o posta elettronica). A tal fine puoi utilizzare il modulo tipo di recesso, ma non e' obbligatorio. Puoi anche compilare e inviare elettronicamente il modulo tipo di recesso o qualsiasi altra esplicita dichiarazione sul nostro sito web, dalla sezione "Ordini" nel "Mio Account". Nel caso scegliessi questa opzione, ti trasmetteremo senza indugio una conferma di ricevimento su un supporto durevole (ad esempio per posta elettronica).

Per rispettare il termine di recesso, � sufficiente inviare la comunicazione relativa all'esercizio del diritto di recesso prima della scadenza del periodo di recesso.

Effetti del recesso

Se recedi dal presente contratto, ti saranno rimborsati tutti i pagamenti che hai effettuato a nostro favore, compresi i costi di consegna (ad eccezione dei costi supplementari derivanti dalla tua eventuale scelta di un tipo di consegna diverso dal tipo meno costoso di consegna standard da noi offerto). Potremo trattenere dal rimborso le somme derivanti da una diminuzione del valore del prodotto risultante da una tua non necessaria manipolazione.

I rimborsi verranno effettuati senza indebito ritardo e in ogni caso non oltre 14 giorni dal giorno in cui siamo stati informati della tua decisione di recedere dal presente contratto.

Detti rimborsi saranno effettuati utilizzando lo stesso mezzo di pagamento da te usato per la transazione iniziale, salvo che tu non abbia espressamente convenuto altrimenti; in ogni caso, non dovrai sostenere alcun costo quale conseguenza di tale rimborso. Il rimborso pu� essere sospeso fino al ricevimento dei beni oppure fino all'avvenuta dimostrazione da parte tua di aver rispedito i beni, se precedente.

Ti preghiamo di rispedire i beni o di consegnarli a Jenhams Books, Dundee, United Kingdom, senza indebiti ritardi e in ogni caso entro 14 giorni dal giorno in cui hai comunicato il tuo recesso dal presente contratto. Il termine � rispettato se rispedisci i beni prima della scadenza del periodo di 14 giorni. I costi diretti della restituzione dei beni saranno a tuo carico. Sei responsabile solo della diminuzione del valore dei beni risultante da una manipolazione del bene diversa da quella necessaria per stabilire la natura, le caratteristiche e il funzionamento dei beni.

Eccezioni al diritto di recesso

Il diritto di recesso non si applica in caso di:

fornitura di giornali, periodici e riviste ad eccezione dei contratti di abbonamento per la fornitura di tali pubblicazioni;
fornitura di contenuto digitale (inclusi applicazioni, MP3, ecc.) mediante un supporto non materiale (per esempio un CD o un DVD) se al momento dell'inoltro dell'ordine hai espressamente consentito all'inizio dell'esecuzione accettando la perdita del diritto di recesso in conseguenza dell'inizio di esecuzione.
