The book critically analyses, reconstructs and compares judicial law-making in English and German courts from comparative, methodological and constitutional perspectives. It maps the differences and commonalities in both jurisdictions and then offers explanatory accounts for these differences and similarities based on constitutional, institutional, political, historical, cultural and international factors.It will be shown that a fundamental unity of statutory interpretation exists in English and German judicial practice in the sphere of rights-consistent and EU-conforming judicial law-making. Die Lebzeit von Ernst Theodor Amadeus Hoffmann fällt mit dem Geburtsjahr 1776 und dem frühen Todesjahr 1822 in eine wichtige Umbruchzeit in der Geistes- und Kulturgeschichte Europas. Die Romantik, die am Anschluss an den Sturm und Drang und der geistigen Auseinandersetzung mit den Klassikern und der Aufklärung begann, ist eine Zeitströmung, in der der verborgene Sinn der Natur, das Geheimnisvolle und der Traum thematisiert werden. Um seinen tristen Alltag zu entfliehen und biographische Themen zu verarbeiten, wurde Hoffmanns Phantasie durch Träume und Visionen angeregt, die in seinen Erzählungen aus der Alltäglichkeit hervorgehen und eine unheilvolle Wirkung auf die betroffene Figur auszuüben scheinen. Die vorliegende Arbeit hat das Ziel, die phantastischen und grotesken Seiten in E.T.A. Hoffmanns schriftstellerischen Werk näher zu beleuchten. Verpackungen haben nicht nur die Aufgabe ein Produkt zu schützen oder zusammenzuhalten, sie sind vielmehr auch Träger von auffälligen Werbeinformationen und sollen durch ihre Aufmachung zum Kauf verführen. Dadurch bedingt kommen unterschiedliche Materialverbunde im Hausmüll zusammen und es entsteht neben dem hohen Müllaufkommen das Problem der Beseitigung oder Wiederverwertung. Es ist ersichtlich, dass das Verhalten jedes Einzelnen von Belang ist, dem zu hohen Müllaufkommen entgegenzuwirken. Die Fähigkeit und Bereitschaft, das eigene Verhalten im alltäglichen Leben hinsichtlich umweltschonender Alternativen zu überdenken und sich eventuell neu zu orientieren, ist eine wichtige Voraussetzung für die Verringerung des Abfalls. Jedoch werden oft erst durch gesetzliche Maßnahmen die erwünschten Verhaltenskonsequenzen erzielt. Durch das Inkraftreten der Verpackungsverordnung seit Anfang der 90er Jahre und dem damit eingeführten Dualen System Deutschland GmbH sahen sich viele Bürger gezwungen, die vom Gesetzgeber geforderten Sortierquoten einzuhalten. Es stellt sich hierbei natürlich die Frage, warum ein sichtlich geringeres Müllaufkommen erst durch gesetzliche Reglementierung bewirkt werden kann und ob die Mitwirkungsbereitschaft der Konsumenten zum umweltbewussten Verhalten auch auf anderem Wege zu erzielen ist Die vorliegende Arbeit setzt sich mit dem Thema des Umweltbewusstseins und -verhaltens bezüglich der Müllproblematik auseinander. Die Behandlung dieser Thematik erscheint mir als wichtig, da die Entwicklung der Umweltkrise bedrohliche Ausmaße angenommen hat, die sich nicht allein durch technologische Strategien lösen lassen, sondern insbesondere einen Werte- und Einstellungswandel in der Gesellschaft voraussetzen, damit sich ein bewussteres Abfallverhalten etablieren kann. Die Zielsetzung der Arbeit besteht darin, einen Überblick der psychologischen Zusammenhänge des Umweltbewusstseins und -verhaltens im Hinblick auf die Problemstellung des zu hohen Abfallaufkommens zu geben.
