Goodrich, Herbert F. Yielding Place to New: Rest Versus Motion in the Conflict of Laws. With an Introduction by Ralph M. Carson. New York: The Association of the Bar of the City of New York, 1950. 33 pp. Hardcover. Original cloth, light shelfwear, internally clean. $10. * Text of the Ninth Annual Benjamin N. Cardozo Lecture Deli…vered Before the Association of the Bar of the City of New York. Goodrich is considered the most distinguished American authority on the conflict of laws since Joseph H. Beale. The text focuses on how judges adapt and improve the rules of law over time. It explores the constant balance between keeping stable legal precedents ("rest") and updating rules for modern life ("motion"). Goodrich argues that the common law is a flexible, living system. He also suggests that total code uniformity across states is not yet possible.
