Cela ne l'empêche pas de constituer une activité économique d'ampleur nationale, qui engage des dépenses de l'État - faibles en France mais sans cependant être négligeables. S'insérant dans un champ très partiellement concurrentiel, il produit de la richesse de par l'activité des auxiliaires de justice qu'elle engendre et s'accompagne fréquemment, in fine, de transferts de richesses parfois très importants. Ces derniers aspects suffiraient déjà à justifier une analyse économique de l'institution et de son fonctionnement ; les interrogations qui se multiplient sur l'efficacité - mot dont on use ici par pure commodité, sans méconnaître la perplexité et les réticences qu'il suscite fort logiquement - de la Justice, son coût pour ses usagers comme pour la collectivité rendent plus légitime encore un tel regard.
