Na de terroristische aanslagen op 11 september 2001 riep de Amerikaanse overheid Operation Enduring Freedom (OEF) in het leven, waarbij zij zich beriep op het recht op zelfverdediging. Dat recht zet het bindende geweldverbod in het Handvest van de Verenigde Naties opzij. Kan 10 jaar na die aanslagen het recht op zelfverdediging nog steeds met succes worden ingeroepen en hoe verhoudt zich dat tot de door de Veiligheidsraad ingestelde ISAF (International Security Assistance Force)-operaties? Hoe zit het met de contraterrorismeoperaties die door OEF worden ondernomen in Afghanistan en andere landen? Kan dat eigenlijk wel volgens het internationale recht? Hoe legitiem is OEF anno 2011 in het voetlicht van het internationale recht? Op deze en andere vragen geeft de auteur een antwoord in zijn oratie. Volgens het internationale recht kan Operation Enduring Freedom niet langer militair geweld gebruiken op grond van het Amerikaanse recht op zelfverdediging als reactie op 9/11, aldus de auteur. Zelfverdediging is namelijk een recht dat slechts kan worden uitgeoefend totdat de Veiligheidsraad voldoende noodzakelijke maatregelen heeft genomen. Dat is in dit geval ook gebeurd. Dat resulteerde onder meer in de ondersteunende ISAF-operaties, die wel geweld mogen gebruiken om hun taak uit te kunnen voeren in de opbouwfase naar een volledig zelfstandige Afghaanse Veiligheidsmacht. Operaties die OEF nog uitvoert in Afghanistan, zoals contraterrorismeoperaties, kunnen alleen met toestemming van de Afghaanse regering plaatsvinden. OEF contraterrorismeoperaties buiten Afghanistan kunnen evenwel nooit onder die toestemming vallen. Dergelijke operaties zijn niet geoorloofd onder het internationale recht.
