Twenty-four pages, complete. Pages are virtually pristine and intact except for light age toning and splitting and slight chipping along sp…ine. A Very Good copy. This pamphlet is No. 52 in a series of pro-Union articles issued by the Loyal Publication Society of New York. The Society was founded in early 1863 to help boost morale for the Union cause through the circulation of pro-Union pamphlets after the Union had suffered a series of defeats in the American Civil War. This pamphlet contains a printed speech by Nathaniel G. Upham (1801-1869), an American judge and entrepreneur. He served as an associate justice of the New Hampshire Supreme Court from 1833-1843. In his speech, Upham discusses the legal status of slaves during the Civil War, his arguments in favor of abolition, and other subjects relating to the War and Reconstrucion. He begins by defining "rebellion" which he says is "armed opposition against the government of a country to which one owes allegiance." He says rebellion culminates into a civil war, the latter of which he describes as a "crime of unparalleled enormity." He notes that "treason extends through one third of the Union." Upham then turns to the current question of what Union forces should do with slaves they encounter in Confederate territory. Upham makes several arguments defending the Union's emancipation of the slaves. First, he says that Confederate slaveholders have foregone their right to claim ownership of slaves because they are now belligerents engaged in war. Upham pointedly states, "As our armies moved into Southern territory, people previously held in involuntary servitude rushed to them for protection." Union General Butler declared these slaves "contraband," thus even if they were to still be regarded as property, they would be legally considered under Union "ownership." Conversely, Upham says, "Or, if the slaves are to be regarded as men . they have an undoubted right to escape from the perverted power over them by the South to the control of the only government to which they owe allegiance, and they may thus strike home with us, as free and loyal men, against a common enemy." Upham reasons further that if a slave escapes in wartime, ". it is to be regarded as a voluntary relinquishment of him by the master . It may be considered a maxim, that the slaveholder who declares war subjects himself, of his own free choice, to the loss of all slaves that may be swept from him in its vortex." Upham also contends that the current time of the Civil War is an "interregnum" which means that peacetime civil laws, such as fugitive slave laws, are suspended. This means slaves who escape to the North are not required by law to be returned to Confederate territory. Upham also says that Confederates are subject to forfeiture of their property due to treason. Upham then cites the Emancipation Proclamation which he then proceeds to analyze and defend. He also relays an account by N. P. Willis in which the latter spoke with a slave on Robert E. Lee's property; she told Willis she knew why exactly the Civil War was being fought, "It's all about what we've been suffering so long." Upham then turns to questions of restoring peace after the War. He argues that only the Union has the right to readmit Confederate states. He also discusses the presidential power of amnesty, terms of peace, and why slavery cannot coexist with permanent peace. He compares the socioeconomic systems of paid labor and slavery and notes several reasons why the former is vastly more beneficial. Upham says, ". slavery is a thriftless, improvident system, as well as a danger to itself ." He says slavery is also incompatible with Christian values. He concludes with a discussion about Reconstruction and a plea to the South.
