Auslöser für die Einsetzung letztgenannten Ausschusses und einer öffentlichen Diskussion in Europa waren die STOA1-Berichte 1997 und 1999. Der Verfasser der ersten Studie behauptete, die NSA2 würde routinemäßig sämtliche Kommunikation über E-Mail, Telefon und Fax innerhalb Europas abhören.3 In den Mittelpunkt der Aufmerksamkeit rückte die Aussage des britischen Journalisten Duncan Campbell im zweiten STOA-Bericht, Echelon werde heutzutage für Wirtschaftsspionage verwendet.4 Dass Nachrichtendienste Kommunikation jeglicher Art abhören, um die Staatssicherheit zu gewährleisten, ist öffentlich bekannt.5 Das Besondere des Echelon- Systems jedoch sind die ihm laut Bericht des EU-Ausschusses zugeschriebenen Eigenschaften. Die Überwachung internationaler Kommunikation zielt logischerweise meist nicht auf die Bewohner des eigenen Landes, so dass das überwachte Individuum ohne innerstaatlichen Rechtsschutz einem solchen System komplett ausgeliefert wäre.
