Así, buscamos, a través de las bases filosóficas y doctrinarias de ambas ciencias, entender el papel de la Economía en el Derecho, a través del movimiento Law & Economics, en tiempos de avance del pensamiento Neoliberal.

Die Anwendung der Wirtschaftswissenschaften in der Rechtswissenschaft erfordert jedoch besondere Sorgfalt, da der Kern der Wirtschaftswissenschaften in der Quantifizierung von Ergebnissen besteht, wobei stets die niedrigsten Kosten für die beste Lösung eines Rechtsstreits angestrebt werden. Bereits die zweite, gibt es eine Lösung von Konflikten durch die Justiz, die, unvermeidlich, entfernt ein besseres Ergebnis für die Gesamtheit, was einige Empörung durch die Verzögerung bei der Lösung von Problemen, vor allem in Brasilien, sowie das Fehlen von Prognosen, um zukünftige Divergenzen zu vermeiden. Daher haben wir versucht, anhand der philosophischen und doktrinären Grundlagen beider Wissenschaften die Rolle der Wirtschaft im Recht durch die Law & Economics-Bewegung in Zeiten des fortschreitenden neoliberalen Denkens zu verstehen. 80 pp. Deutsch.
