Ein rechtsvergleichender Blick auf die Rolle unbestimmter Tatbestandsmerkmale im Ausland geht dem voraus. Es folgen Fixierungen des Problems im Netzwerk der Verweisungstechniken, deren sich die Gesetzgebung auf dem Gebiet des Wirtschaftsstrafrechts zunehmend bedient. Unter den einschlägigen Kriminalitätsfeldern richtet sich das Interesse dann auf das Kapitalmarktstrafrecht, dessen Entwicklung infolge europarechtlicher Vorgaben besondere Aufmerksamkeit verdient. Unter dem Eindruck, dass der gegenwärtige Status unseres Wirtschafts- und Finanzsystems eine sinnvolle Verfolgung von Wirtschaftsstraftaten vielleicht nicht mehr möglich macht, stellt sich die Frage, ob es nicht im Wirtschaftsleben auch um politische Straftaten gehen könne, die noch nicht tatbestandlich fixiert sind. Dann werden Schwerpunkte des Wirtschaftsstrafrechts auf den Prüfstand der Ausgangsfrage gestellt. Ein rechtsvergleichender Blick auf die Rolle unbestimmter Tatbestandsmerkmale im Ausland geht dem voraus. Es folgen Fixierungen des Problems im Netzwerk der Verweisungstechniken, deren sich die Gesetzgebung auf dem Gebiet des Wirtschaftsstrafrechts zunehmend bedient. Unter den einschlägigen Kriminalitätsfeldern richtet sich das Interesse dann auf das Kapitalmarktstrafrecht, dessen Entwicklung infolge europarechtlicher Vorgaben besondere Aufmerksamkeit verdient. Es folgen Erörterungen zu Berechnungen des Vermögensschadens, zur Reichweite des Umweltstrafrechts und der Tatbestände der Korruption. Den Abschluss bildet die Durchmusterung des Wirtschaftsstrafrechts daraufhin, ob die Verwendung unbestimmter Merkmale mit Blick auf symbolische Wirkungen bewusst geschieht.
