Yankwich, who served as the Chief U.S. District Judge for the Southern District of California. Originally published in The Canadian Bar Review in 1953, the work examines how California's legal system evolved from its diverse cultural roots into a common law system. It explores how law reflects the shifting "convictions, sentiments, and prejudices" of a society over time. The transition from the Spanish and Mexican legal systems-specifically the Alcalde system-to the American Common Law system. Yankwich discusses specific outdated practices like conciliacion (a mandatory conciliation process before trial), which he notes eventually became obsolete as it was viewed as a "useless formality" by American settlers. The text analyzes how early California law was influenced by the era's social norms, including sections on "Prejudice in the Form of Law". The article is structured into several sections, including "The California Heritage," "The Common Law System," "Vestiges of the Old Systems," and "Conciliacion". The recipient of the author's letter is almost certainly Leonard Herman Verbarg (1903-1984), Californian journalist and local historian.
