Oktav. XXIII, 616 S. Späterer Halbleinenband mit Buntpapierüberzug auf den Buchdeckeln. P.4220.l. Charles Fearne (1742-1794) publizierte dieses Einführungswerk erstmals 1773 ebenfalls in London. Es geht um ein erbrechtliches Thema und dessen Handhabung an den englischen Gerichten. Die Monographie über die bedingten Vermächtnisse… und testamentarische Verfügungen, die behandelt werden, waren ein großer Erfolg. Einige Auflagen folgten der Erstzausgabe 1773. Die Ausgabe 1809 ist besonders erwähnenswert, weil Bezug genommen wird auf den Code Napoléon, der im gleichen Jahr erschienen ist: "It is observable thet the Code de Napoléon, (Art. 720, 721 & 722) provides for such cases, by declaring (720)." Es geht um mehrere Personen, die wechselseitig zu Erben eingesetzt wurden, aber durch das gleiche Ereignis ums Leben gekommen sind, ohne dass man unterscheiden kann, welche Person zuerst gestorben ist. Dann gelten Vermutungen darüber, wer zuerst und wer später verstorben ist und demnach als Erbe gilt. Herangezogen werden sollen Umstände der Begebenheit, das Alter oder das Geschlecht. Scire autem propriè est, rem ratione et per causam cognoscere, Lateinische Zitate waren sehr beliebt zu dieser Zeit. Latein als Juristensprache war den englischen Juristen vertraut.
