An aggregate, integrated economic-hydrologic river basin model is developed to analyze these issues for the Mekong River Basin in Southeast Asia. Die Rechtsunsicherheit ist wegen der Komplexität der Auswahlentscheidung extrem hoch. Die Rechtsprechung gab darüber hinaus Anl…aß zu weiterer Rechtsunsicherheit: Das BAG formte aus1 III KSchG zusammen mit den Generalklauseln (242, 315 BGB) einen allgemeinen Rechtsgedanken und ordnete eine - wenn auch abgeschwächte - Sozialauswahl in Bereichen an, die von1 III KSchG nicht erfaßt werden. Dadurch wurde die Sozialauswahl mit zwei weiteren Unsicherheitsfaktoren belastet: mit den Grenzen der sozialen Auswahl im Arbeitsrecht einerseits und dem fehlenden Maßstab einer abgeschwächten Auswahl andererseits. Aufgrund dieser Rechtsunsicherheit betritt der Verfasser bisher nur vereinzelt bearbeitetes Terrain: Die Arbeit analysiert, ob der Arbeitgeber außerhalb des gesetzlichen Anwendungsbereichs des1 III KSchG verpflichtet ist, eine Sozialauswahl durchzuführen. Es wird geklärt, ob die Sozialauswahl als allgemeines Rechtsprinzip des Arbeitsrechts angesehen werden kann. Die Untersuchung betrachtet Auswahlentscheidungen, die auf den ersten Blick nicht unter den Wortlaut des1 III KSchG subsumiert werden können.
