The exercise by States of criminal jurisdiction for conduct occurring outside their territory and conflicting claims are part of the daily legal landscape. Going through the early attempts by the Institut de Droit International to address conflicts of criminal law in the area of competence, starting from what the author calls the "Belle Époque" of international law, is an experience in and of itself. Conflicts of criminal laws are a somewhat exotic topic, reflecting an approach aimed at addressing the solution of conflicts of laws and preventing their most evident repercussion, jurisdictional conflicts, in the same shape as conflicts of laws under private international law, seeking the closest link existing between a certain situation and legislation and judicature. The approach reflected rather a "cultural attitude" to establish a level of cooperation with other States "below that of public international law". Indeed, jurisdictional conflicts in criminal matters are impossible to keep at a level not encroaching on the sensibility of States, even if they do not involve the scrutiny of the exercise of public functions. The idealistic attempts to address conflicts of criminal laws are, in any case, inspiring and provide an insight into an age by no way less complex than the contemporary world, in which a small group of talented individuals believed to track the path of the development of international law. ----- Jean Paul Pierini serves as an officer on active duty in the Italian Navy holding the position of deputy head of the Office for Legal Affairs at the General Staff. In the present work the author studies how efforts at understanding the juridic relationship between the Apostolic See and the Eastern Catholic Churches over the past roughly five hundred years have led to the increased recognition of the juridic autonomy of those Churches. The work first focuses on the early jurisprudence concerning the binding force of papal legislation on Eastern faithful, highlighting an important though unapproved decision made by a particular congregation of the Sacred Congregation for the Propagation of the Faith in 1631, which declared that the popes did not intend to bind the subjects of the sees of the schismatic patriarchs by certain types of apostolic constitutions except in three particular cases. The work then reviews the jurisprudence of Pope Benedict XIV, who cited this decision three times in his writings; the events of the pontificate of Pope Pius IX, particularly those surrounding the First Vatican Council when the preconciliar commission on the Churches of the Eastern rite sought to suppress the praxis based on this decision; the period of the first codification of canon law, when this decision was reaffirmed in praxis; and, finally, the Second Vatican Council and the second codification period, when this decision became the basis for canon 1492 of the Eastern code. This study emphasizes the impact that the jurisprudence surrounding the 1631 decision has had on how the understanding of Eastern juridic autonomy has developed in the Catholic Church. It also shows how the current canonical norms impacting Eastern autonomy can be better understood in light of this historical development. Sean T. Despite being fragmented, this gallery bears witness of the need, the persistence, and the stylistic flexibility of a style embodied by the Byzantine character: that is to say, of its eagerness to understand, and therefore to believe and hope. Just as many monuments have been destroyed by humans, likewise a small or large portion of what is presented in this book will also disappear: may these pages reassert the presence of a culture which, one hopes, will always find new and sincere lovers. The volume will be published for the celebrations of the Pontificio Istituto Orientale's (PIO's) centenary: it was an honour that P. Guillaume de Jerphanion gave the opening lesson of the course on Byzantine frescoes. Our most sincere gratitude also to the two Rectors of the PIO, PP.
