Paperback. Condizione: Good. Understanding federalism - the form of political organization that unites separate polities within an overarching political system so that all maintain their political integrity - is central to the study of democratic government in the United States. Yet, many political scientists treat federalism as a set of abstract principles or a maze of budgetary transfers with little connection to real political life. This concise and engaging book boils the discussion down to its essence: federalism is about power, specifically the tug for power among and within the various levels of government. Author Larry N. Gerston examines the historical and philosophical underpinnings of federalism; the various change events that have been involved in defining America's unique set of federal principles over time; and the vertical, horizontal, and international dimensions of federalism in the United States today. The result is a book examining the ways in which institutional political power is both diffused and concentrated in the United States.…

Hardback. Condizione: Good. In the U.S. legal system, the federal government has traditionally been the only rightful arena for the conduct of foreign affairs, especially in the case of national security, military action, international trade, and treaty-making. However, the pervasiveness of globalization and the attendant ease of cross-border interactions, with implications for commerce and terrorism, have brought U.S. states, counties, and municipalities increasingly into the federal government's long-standing province of international relations. For example, states now forge trade relationships with foreign governments through energy and investment contracts that very much resemble treaties. If a foreign sovereign violates any of these contracts or statutes, then civil or criminal action against that sovereign could interfere with the U.S. federal government's diplomatic relations overseas. Consequently, the legal status of states and local governments in the conduct of foreign affairs is unclear and in need of thoughtful analysis and guidance. In Foreign Affairs Federalism, Michael Glennon and Robert Sloane study the constitutional allocation of foreign affairs powers between the federal government and the states. They explain the current law clearly and accessibly, identifying those areas where the law can be confidently ascertained. Where the law cannot be determined, they suggest the most plausible or compelling perspectives on existing doctrine. They also appraise existing doctrine against the background of the diverse and incompatible goals and challenges facing the United States in the twenty-first century.…

Paperback. Condizione: Fair. In this profound and fascinating book, the authors revisit an overlooked Supreme Court decision that changed forever how justice is carried out in the United States. In 1906, Ed Johnson was the innocent black man found guilty of the brutal rape of Nevada Taylor, a white woman, and sentenced to die in Chattanooga, Tennessee. Two black lawyers, not even part of the original defense, appealed to the Supreme Court for a stay of execution, and the stay, incredibly, was granted. Frenzied with rage at the decision, locals responded by lynching Johnson, and what ensued was a breathtaking whirlwind of groundbreaking legal action whose import, Thurgood Marshall would claim, "has never been fully explained." Provocative, thorough, and gripping, Contempt of Court is a long-overdue look at events that clearly depict the peculiar and tenuous relationship between justice and the law.…

Paperback. Condizione: Good. Why federalism is pulling America apart?and how the system can be reformedFederalism was James Madison's great invention. An innovative system of power sharing that balanced national and state interests, federalism was the pragmatic compromise that brought the colonies together to form the United States. Yet, even beyond the question of slavery, inequality was built into the system because federalism by its very nature meant that many aspects of an American's life depended on where they lived. Over time, these inequalities have created vast divisions between the states and made federalism fundamentally unstable. In The Divided States of America, Donald Kettl chronicles the history of a political system that once united the nation?and now threatens to break it apart.Exploring the full sweep of federalism from the founding to today, Kettl focuses on pivotal moments when power has shifted between state and national governments?from the violent rebalancing of the Civil War, when the nation almost split in two, to the era of civil rights a century later, when there was apparent agreement that inequality was a threat to liberty and the federal government should set policies for states to enact. Despite this consensus, inequality between states has only deepened since that moment. From health care and infrastructure to education and the environment, the quality of public services is ever more uneven. Having revealed the shortcomings of Madison's marvel, Kettl points to possible solutions in the writings of another founder: Alexander Hamilton.Making an urgent case for reforming federalism, The Divided States of America shows why we must?and how we can?address the crisis of American inequality.…

Hardback. Condizione: Good. This study examines how the Electoral College actually works, how it is supposed to work, and how it might be reformed. Robert Hardaway first looks at the Constitutional Convention, the Twelfth Amendment, and historical elections where the Electoral College has come into play, providing the historical background to the present-day College. Next he examines the electors themselves--how they are chosen in the states and the laws relating to the obligations of electors in casting their votes. The election of the president and vice president by the House of Representatives is also examined. Finally, Hardaway discusses and analyzes the proposed reforms to the Electoral College, including those before the Congress at present. Professor Hardaway's book makes a strong case for the preservation of the federalist principles incorporated into the constitutional framers' plan for election of the president of the United States. The book richly documents its case with examples from past elections, while at the same time providing the reader with all information needed to make an independent judgment.…
