Informazioni sul diritto di recesso

Diritto legale di recesso

Hai il diritto di recedere dal presente contratto entro 14 giorni senza fornire alcuna motivazione.

Il periodo di recesso scade dopo 14 giorni dal giorno in cui tu o una terza parte, diversa dal vettore e da te indicata, acquisisce il possesso fisico dell'ultimo bene o dell'ultimo lotto o pezzo.

Per esercitare il diritto di recesso, compila e invia elettronicamente una dichiarazione esplicita sul nostro sito Web, alla voce “I miei acquisti” nella sezione “Mio account”. Ti comunicheremo senza indugio una conferma di ricezione di tale recesso su un supporto durevole (ad es. via e-mail).

Per rispettare il termine di recesso, è sufficiente inviare la comunicazione relativa all'esercizio del diritto di recesso prima della scadenza del periodo di recesso stesso.

Effetti del recesso

In caso di recesso dal presente contratto, ti rimborseremo tutti i pagamenti ricevuti, compresi i costi di spedizione (ad eccezione dei costi supplementari derivanti dalla tua eventuale scelta di un tipo di spedizione diverso dal tipo meno costoso di consegna standard da noi offerto).

Potremo effettuare una detrazione dal rimborso per la perdita di valore dei beni forniti, qualora tale perdita sia il risultato di una manipolazione non necessaria da parte tua.

Eseguiremo il rimborso senza indebito ritardo e non oltre 14 giorni dal giorno in cui saremo informati della tua decisione di recedere dal presente contratto.

Il rimborso sarà effettuato utilizzando lo stesso mezzo di pagamento da te usato per la transazione iniziale, salvo che tu non abbia espressamente concordato altrimenti; in ogni caso, non dovrai sostenere alcun costo quale conseguenza di tale rimborso.

Possiamo trattenere il rimborso finché non avremo ricevuto i beni oppure finché non avrai fornito la prova di averli rispediti, a seconda di quale condizione si verifichi per prima.

Dovrai rispedire i beni o consegnarli a Il Cartiglio di Roberto Cena srlu, TORINO, Torino, Italy, +39 011 817 90 05, senza indebito ritardo e, in ogni caso, entro 14 giorni dal giorno in cui ci hai comunicato la tua volontà di recedere dal presente contratto. Il termine è rispettato se rispedisci i beni prima della scadenza del periodo di 14 giorni. I costi diretti della restituzione dei beni saranno a tuo carico. Sei responsabile solo della diminuzione del valore dei beni risultante da una manipolazione diversa da quella necessaria per stabilire la natura, le caratteristiche e il funzionamento dei beni stessi.

Eccezioni al diritto di recesso

Il diritto di recesso non si applica a:

1. La fornitura di giornali, periodici o riviste ad eccezione dei contratti di abbonamento; e
2. La fornitura di contenuto digitale non fornito su un supporto materiale (ad es. su un CD o DVD), se al momento dell'invio dell'ordine hai accettato l'inizio dell'esecuzione e hai riconosciuto che non avresti potuto recedere una volta iniziata l'esecuzione.

I costi di spedizione sono calcolati su un peso medio di un chilo (2,2 libbre) per libro. Se il libro ordinato ha un peso maggiore o è troppo grande provvederemo ad informarLa di eventuali costi aggiuntivi.

DATA PROTECTION POLICY

LIBRERIA ANTIQUARIA IL CARTIGLIO SNC respects your privacy, and is deeply committed to protecting your personal data and empowering you to control how it is used.

This Data Protection Policy (hereafter “Policy”) applies to residents of EU states and certain other customers in states whose governments adopt Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regards to the processing of personal data and on the free movement of such data “General Data Protection Regulation” (“GDPR”). This Policy is intended to ensure that Customer Personal Data (defined as “any information relating to an identified or identifiable natural person”) is collected, maintained and used in accordance with the GPDR and associated data protection and privacy laws.

This Policy describes what kinds of Personal Data LIBRERIA ANTIQUARIA IL CARTIGLIO SNC will collect from our European Customers, and how LIBRERIA ANTIQUARIA IL CARTIGLIO SNC maintains and uses our Customers’ Personal Data in connection with the services we provide to them.

Customer should be aware that application fields are mandatory fields, because LIBRERIA ANTIQUARIA IL CARTIGLIO SNC needs this information to comply with statutory, legal or contractual requirements, internal procedures or to respond to Customer requests.

Fields: LIBRERIA ANTIQUARIA IL CARTIGLIO SNC may request include: Email, Mobile Phone number, Name, Home address, Date of birth and other. If Customer contacts LIBRERIA ANTIQUARIA IL CARTIGLIO SNC will keep a record of that correspondence for the legally required retention period.

Personal Data that Customers provide to LIBRERIA ANTIQUARIA IL CARTIGLIO SNC should not include any of the following data types, and Customers hereby expressly warrant that they will not provide any of the following:

racial or ethnic origin;
political opinions;
religious or philosophical beliefs;
trade union membership;
genetic data;
biometric data;
private health data concerning a Customer;
data concerning a natural person's sex life or sexual orientation.

LIBRERIA ANTIQUARIA IL CARTIGLIO SNC may use Customer Personal Data to send direct marketing to our Customers via e-mail only when Customer has given express prior consent in the relevant contact form. Customer may at any time withdraw approval to receive marketing communications by expressly withdrawing consent via mail at INFO@CARTIGLIO.IT or using the newsletter unsubscribe functionality

LIBRERIA ANTIQUARIA IL CARTIGLIO SNC will not rely solely on automated Customer onboarding processes or transaction monitoring, including profiling.

How does LIBRERIA ANTIQUARIA IL CARTIGLIO SNC use Customer Personal Data?

Customer Personal Data is collected and handled by LIBRERIA ANTIQUARIA IL CARTIGLIO SNC for the following purposes:

to deliver LIBRERIA ANTIQUARIA IL CARTIGLIO SNC services (including to respond to Customer requests or questions, to investigate or respond to potential incidents and complaints);
to comply with applicable statutory, legal and regulatory obligations (including but not LIBRERIA ANTIQUARIA IL CARTIGLIO SNC to the fight against money laundering and terrorist financing).

Data Security.

Although LIBRERIA ANTIQUARIA IL CARTIGLIO SNC will do its best to protect Customer Personal Data, every Customer should be aware and is hereby informed that the transmission of information via the internet is not inherently secure. CRIMINAL HACKERS AND OTHER BAD ACTORS WILL ATTEMPT TO STEAL YOUR DATA AND DIGITAL ASSETS! LIBRERIA ANTIQUARIA IL CARTIGLIO SNC cannot guarantee the security of Customer Personal Data transmitted to LIBRERIA ANTIQUARIA IL CARTIGLIO SNC or any third party; for this reason, ANY TRANSMISSION IS AT CUSTOMER’S OWN RISK.

LIBRERIA ANTIQUARIA IL CARTIGLIO SNC will use industry standard (or better) technical and organizational security measures safeguard against unauthorized access, change, transmission or deletion of Customer Personal Data.

Customer rights: How can a Customer access, object, rectify, and delete its Personal Data?

Under applicable data protection laws, Customer has the following rights:

Right to access and obtain a copy of Customer Personal Data: Customer is entitled to request confirmation if and when LIBRERIA ANTIQUARIA IL CARTIGLIO SNC processes your Customer Personal Data. Customer may have access to Personal Data and learn details upon request about how it is maintained and used. In some cases, Customer can ask LIBRERIA ANTIQUARIA IL CARTIGLIO SNC to provide Customer with an electronic copy of Personal Data.
Right to object to marketing: if Customer expressly objects to LIBRERIA ANTIQUARIA IL CARTIGLIO SNC’s use of Customer Data for marketing purposes, LIBRERIA ANTIQUARIA IL CARTIGLIO SNC will put Customer personal contact information (name, address, telephone number, fax number, e-mail address) on a specific list to ensure that Customer no longer receives this material. The Customer Data will be maintained and used for non-marketing purposes unless and until Customer expressly withdraws the objection to marketing in writing.
Right to rectify Personal Data: If evidence can be provided that Personal Data LIBRERIA ANTIQUARIA IL CARTIGLIO SNC holds about Customer is inaccurate, or needs to be updated, Customer can update this data via the IL CARTIGLIO SNC wallet interface.
Right to be forgotten/Personal data erasure: In certain circumstances, Customers have the right to have their personal data deleted. Customer may make such a request at any time in writing and LIBRERIA ANTIQUARIA IL CARTIGLIO SNC will evaluate if Customer’s request should be granted.
However, this right is subject to overriding legal rights or obligations; LIBRERIA ANTIQUARIA IL CARTIGLIO SNC may be legally required to retain European Customer data, including in cases of suspicious transactions as to which LIBRERIA ANTIQUARIA IL CARTIGLIO SNC is legally obligated to retain all relevant records, or to conduct internal investigations, or to use European Customer data (while safeguarding a specific identity) for purposes of general data security. For situations where, in accordance with the law, LIBRERIA ANTIQUARIA IL CARTIGLIO SNC determines that a Customer’s data deletion request must be granted, LIBRERIA ANTIQUARIA IL CARTIGLIO SNC will do so without undue delay. To the extent LIBRERIA ANTIQUARIA IL CARTIGLIO SNC’s retention or use of European Customer Personal Data is based on Customer consent, the Customer also has the right to withdraw consent at any time. Withdrawal of Customer consent pursuant to this Policy will not affect the lawfulness of any processing based on Customer consent before the receipt of such withdrawal.

LIBRERIA ANTIQUARIA IL CARTIGLIO SNC will only send marketing communications via email and catalogue. Customer may opt out of any further marketing communications using the un-subscribe right at any time by contacting LIBRERIA ANTIQUARIA IL CARTIGLIO SNC at INFO@CARTIGLIO.IT and providing the following information: Customer name, email address, the marketing communications to unsubscribe.

Otherwise, the un-subscribe option will be always available in every marketing communications in the bottom panel of the emails

Changes to this Policy.

The terms of this Policy may be amended from time to time in accordance with LIBRERIA ANTIQUARIA IL CARTIGLIO SNC's internal rules and/or change in law or regulation. LIBRERIA ANTIQUARIA IL CARTIGLIO SNC shall publish any material changes to this Policy either on its Website or contacting Customer using other communication channels
