Jahrgang, Heft 7». - Eugen Huber (geb. 1849, Oberstammheim, gest. 1923, Bern): «Studium in Zürich, Genf und Berlin, 1872 Dr. iur. Vorlesungen bei Rudolf von Jhering, Johann Adolf Tomaschek und Lorenz von Stein in Wien. Ab Mai 1873 war Eugen Huber als Journalist für die Neue Zürcher Zeitung (NZZ) tätig, ab 1876 als Chefredaktor. 1877 entschloss er sich angesichts der vielen Konflikte im Kontext des Eisenbahnbaus zum Rücktritt und wurde Ende Jahr Polizeivorsteher und Untersuchungsrichter in Trogen. Im Frühjahr 1881 erhielt er einen Ruf als Professor für öffentliches Bundesrecht, Zivilrecht und schweizerische Rechtsgeschichte der Universität Basel. Der schweizerische Juristenverein betraute ihn 1884 mit der Aufgabe, eine vergleichende Übersicht über die 25 kantonalen Gesetzgebungen im Hinblick auf eine Vereinheitlichung des Privatrechts zu erstellen. Aus diesem Auftrag erwuchs Hubers vierbändiges Werk "System und Geschichte des schweizerischen Privatrechts" (1886-1893), dessen erste drei Teile die verschiedenen kantonalen Rechtssysteme darstellen, während der vierte eine Geschichte des schweizerischen Privatrechts entwirft. Für den Historiker Huber trägt der Blick in die Vergangenheit zu einer positiven Bewertung des Gewohnheitsrechts bei, das vom spezifischen Charakter des schweizerischen Staatswesens in seiner ganzen Einmaligkeit und Vielfalt zeugt. In den vielen lokalen Rechtsgewohnheiten mittelalterlichen Ursprungs, die in den meisten Kantonen teilweise noch praktiziert werden, erkannte er Ansätze eines helvetischen "Volksgeists", der ihm als Grundlage für die Vereinheitlichung des schweizerischen Privatrechts geeignet erschien. 1888-1892 lehrte Huber Handelsrecht und deutsches öffentliches Recht in Halle. Seine Freundschaft mit Rudolf Stammler und Max von Rümelin übte entscheidenden Einfluss auf seine Rechtsauffassung aus. Die Universität Bern berief ihn 1892 auf den Lehrstuhl für schweizerisches Privatrecht, Rechtsgeschichte und Rechtsphilosophie. Ausserdem erteilte ihm das Eidgenössische Justiz- und Polizeidepartement (EJPD) den Auftrag, das Privatrecht zu vereinheitlichen und einen Vorschlag für ein schweizerisches Zivilgesetzbuch (ZGB) auszuarbeiten. 1900 wird Hubers Text als Vorentwurf des EJPD veröffentlicht.
