Auslegung und Anwendung der richterlichen Aufklärungspflicht, obwohl gemeinhin als ein Eckpfeiler des ZivilprozeÃrechts bezeichnet, weisen in Theorie und Praxis seit jeher eine groÃe Bandbreite auf: Sie reicht von bloÃem Formalismus zur Ver…meidung des Vorwurfs eines GesetzesverstoÃes bis zur damit gerechtfertigten ungefragten und weitgehenden Unterstützung der Parteien durch den Richter. Dabei ist die Begründung der jeweiligen Sicht meist dogmatischer Natur, auch wenn hier methodisch vorrangig das Gesetz heranzuziehen wäre. Doch dieses bildet häufig nicht den Ausgangspunkt der Betrachtung, sondern deren Ende; ein Ergebnis wird dem Gesetz übergestülpt. Das gilt nicht nur für die aktuelle deutsche ZPO, sondern auch für die Allgemeine Gerichtsordnung PreuÃens. So entstand der häufig beschriebene Gegensatz beider Rechte in jenem Bereich. Aber auch für diese Frage ist die Antwort allein im Gesetz zu finden, ausschlaggebend dafür ist die Gestaltung des Verhältnisses von Richter und Parteien. Gerade die Reformierung beider Gesetze zeigt den Wandel des Verständnisses sowie Parallelen und Unterschiede der Gesetze deutlich auf. So muà konstatiert werden, daà jener Gegensatz in der propagierten Eindeutigkeit niemals bestand und sich die Unterschiede durch die Novellierung der ZPO noch weiter verringerten: Die ZPO ist heute sowohl ihrer Regelung wie auch ihrem Anspruch nach dem preuÃischen Recht deutlich näher als während ihres Erlasses. Die Betrachtung der Gesetzgebungsgeschichte zeigt dabei unmiÃverständlich, welche Auffassung hierzu jeweils während der letzten beiden Jahrhunderte herrschte und welche Auslegung aktuell durch das normierte Verhältnis von Richter und Parteien geboten ist. Der erste Hauptteil der Arbeit behandelt die Umstände der Entstehung des Corpus Juris Fridericianum sowie dessen Modifizierung zur Allgemeinen Gerichtsordnung. Beide Gesetze sind detailliert beschrieben. Die Revision der AGO und ihre Abänderung durch Verordnungen von 1833 und 1846 sowie ihre wechselnde Bewertung im Laufe des 19. Jahrhunderts werden dargestellt, ebenso Versuche zur Ablà sung der AGO durch jeweils neue Gesetzesentwürfe. Der zweite Hauptteil der Arbeit umfaÃt die Entstehung der deutschen CPO, ausgehend von den ihr zugrunde liegenden Entwürfen. Die Regelungen des Gesetzgebers werden ausführlich erà rtert, zudem finden insbesondere die Novellen zur ZPO Berücksichtigung. Die Entwicklung des Verhältnisses von Richter und Parteien wird bis zur aktuellen Gesetzgebung zusammenhängend beschrieben. Insgesamt zeigt sich ein mehrfacher Wandel der Lesart und der Einstellung gegenüber beiden Gesetzen, der bislang nur ungenügend berücksichtigt wurde. Die genaue Betrachtung der Maximentheorie deckt dabei den geringen Wert von Begriffen wie Untersuchungs- und Verhandlungsmaxime für das Verständnis und die Einordnung des aktuellen wie des historischen Rechts auf.
