Der Heidelberger Rechtsprofessor Affolter suchte aus den Institutionen Justinians die Strukturen des Allgemeinen Teils unseres BGB herauszuschmelz…en. Dabei ging er historisch vor, weil offensichtlich auch der Allgemeine Teil nicht die Vorkommission oder die Erste, schon gar nicht die Zweite Kommission geschaffen, sondern bestenfalls ausformuliert und in Gesetze gegossen hat. Urprünglich waren die Institutionen ein Lehrbuch, das vor allem in den wichtigsten Teil des Corpus iuris civilis, den komplizierten und sehr inhaltsintensiven Digesten, einführen sollte. Kaiser Justinian erhob das Lehrbuch im sechsten Jahrhundert zusammen mit den anderen Teilen des Corpus iuris civilis zum Gesetz, um eine einheitliche Ausbildung zu gewährleisten. Rechtspolitisch gesehen ist diese Maßnahme auch ein kaiserlicher Unterwerfungswille, der immer lebendig wurde, wenn das Volk in eine vorgegebene Ordnung gezwungen werden sollte. Inhaltlich werden die allgemeine Rechtsgrundsätze angesprochen. Im Zeitalter des Europäischen Ius Commune, gemeint ist die Zeit bis zur Entstehung der nationalen Gesetzbücher im 19. Jahrhudnert, wurden die Institutionenlehrbücher ebenfalls als Einführungsgswerke in das Rechtsstudium geschrieben und von den Studenten in diesem Sinne auch benutzt. Der Professor für Institutionen war in dieser Zeit die unterste Stufe in der Hierarchie der juristischen Lehrstühle. Aber die Institutionenlehrbücher bedeuteten auch mehr. Gelegentlich wurde versucht, darin eine ideale Rechtsordnung zu sehen. Man untersuchte die Rechtsinstitute vom Ius Romanum der ersten nachchristlichen Jahrhunderte bis zum 18. Jahrhundert und schöpfte daraus die Quintessenz. Damit wird bereits der Weg zu einem Allgemeinen Teil beschritten. Affolter spürt dies meisterhaft, wenn auch etwas chaotisch auf und zeigt die Entwicklungslinien, stellt die wichtigsten Systeme und Institutionenlehrbücher vor. Ein zweites Moment weist das Werk von Affolter auf. Für ihn wie für jeden kundigen Juristen gab es die Polarisierung von fremden, römischen Recht und deutschen, einheimischen Recht nicht. Das ist im bisweilen kleinlich denkenden, bisweilen nassforsch national ausgerichteten 19. Jahrhundert gerne rechtspolitisch missbraucht worden. Welche Verbiegungen und Katastrophen sich daraus entwickelten, haben wir im 20. Jahrhundert erleben müssen. Die Institutionen, wie auch die Digesten Justinians waren und sind universales Recht, schon damals im Zeitalter des Ius Romanum Weltrecht. Das wiederholte sich, als das Ius Commune Europäisches Recht war und auch im Europäischen Diskurs weiterentwickelt wurde. Heute, wenn wir vor der Globalisierung nicht nur der Wirtschaft stehen, ergreift das Ius Romanum in welchem Gewande auch immer dort die Stimme, wo der Blick auf die Welt gerichtet ist und verliert leider dort an Wert, wo man diesen Blick schon wieder verkleinert. Ein drittes Moment führt uns Affolter eindringlich und in wunderbarer Anschaulichkeit vor. Er beginnt mit einem Zitat von Ulpian, von den römishen Juristen einer der bedeutendsten, zu Beginn der Digesten (D.1,3,41: de legibus). Es geht, wie Affolter schreibt, um die rechtsverhältnisse, ein wichtiger Abschnitt im AT: "Jedes objektive Rechtsverhältnis ist eine historische Erscheinung und hat als solche seinen eigenen Lebenslauf. Es wird erschaffen, lebendig erhalten und findet schließlich sein Ende". Das ist, so Affolter, "Inhalt und Zweck meiner Abhandlung". Und dann zitiert Affolter das lateinische Original. Man muss noch nicht einmal Latein können, um die Einzigartigkeit der lateinischen Sprache als Juristensprache zu erspüren oder zu erleben. Schon der Rhythmus der Sprache ist einzigartig: "Totum autem ius consistit aut in adquirendo aut in conservando aut in minuendo." Man kann das Zitat selbst zu Ende lesen, nur der Analphabet kann den sc.
