Dass die Abschaffung der Folter stets als Meilenstein auf dem Weg zum Rechtsstaat galt und zentraler Bestandteil des Selbstverstandnisses zumindest westlicher Rechtssysteme ist, scheint dabei in Vergessenheit zu geraten. Die Beitrage dieses Bandes analysieren einerseits die im 18. Jahrhundert zunehmend proklamierte Abschaffung der Folter sowie die vielfaltigen Erscheinungsformen und -funktionen, die Folter auch danach noch besass. Im Fokus stehen die Ungehorsamsstrafen des 18. und 19.Jahrhunderts ebenso wie die von Polizei und Militar nicht nur in den Kolonien ausgeubten Folterdelikte bis hin zu dem Foltervorwurf der RAF.
