Es stellt sich die Frage nach der Vereinbarkeit beider Straftatbestände mit dem deutschen Grundgesetz bzw. der italienischen Verfassung, da sie in die Meinungsfreiheit eingreifen. In Deutschland wird die einfache Leugnung des Holocaust eher als Tabubruch bestraft, was den Eingriff in die Meinungsfreiheit fragwürdig macht, selbst wenn er aufgrund der Vergangenheit Deutschlands nachvollzierbar ist. In Italien hingegen erscheint die Bestrafung zum Teil tautologisch, da die leugnende Propaganda keine direkte Diskriminierung darstellt, sodass der Eingriff in die Meinungsfreiheit zum Schutz der Menschenwürde nicht gerechtfertigt ist. 397 pp. Deutsch.
