Nell'Italia centro-settentrionale del XII secolo le parti in conflitto avevano a disposizione una grande varietà di mezzi alternativi (faida, arbitrato, tribunale signorile, tribunale cittadino, curia papale, imperatore) con i quali raggiungere il proprio obiettivo. Potevano poi scegliere tra norme, argomentazioni, rituali del diritto longobardo, di quello feudale, romano, canonico, cittadino, o di consuetudini locali, ma anche mescolare tutto insieme, più o meno consapevolmente. Basandosi su una documentazione abbondante, come quella della Toscana del XII secolo, su una bibliografia aggiornatissima, e sui concetti elaborati dall'antropologia giuridica, Wickham presenta al lettore, in modo straordinariamente chiaro, le procedure che regolavano la vita quotidiana, sia nei tribunali sia nelle aspettative concrete delle persone, e il modo in cui potevano essere manipolate. Ne risulta una ricostruzione del funzionamento delle pratiche sociali che, nell'ultima parte del libro, è messa a confronto con situazioni e modelli europei ed extraeuropei.
