Based on the dogmatic models of control competence represented in the literature, the work examines the actual decision-making behavior of the court and then devotes itself to the determination of control limits with recourse to functional-legal arguments.; Die Arbeit beschäftigt sich mit der Kontrolltätigkeit des Bundesverfassungsgerichts bei Verfassungsbeschwerden in kindschaftsrechtlichen Fällen. Die Arbeit untersucht zunächst das tatsächliche Entscheidungsverhalten und vergleicht dabei Trennungsentscheidungen mit Entscheidungen zum Umgangsrecht, zur Alleinsorge und zur Vormundschaft. Das Gericht prüft die fachgerichtlichen Entscheidungen bei hoher Eingriffsintensität, d. h. in Trennungsfällen, besonders eingehend. Die Kontrolle erstreckt sich insbesondere auf die fachgerichtliche Tatsachenarbeit, das Gericht betätigt sich als Superberufungsinstanz. Anschließend widmet sich die Arbeit dem normativen Problem der Bestimmung der Kontrollgrenzen des Bundesverfassungsgerichts und greift dafür auf funktionell-rechtliche Argumente zurück. Die Untersuchung kommt zu dem Ergebnis, dass die empirische Unterlegenheit des Bundesverfassungsgerichts und seine faktische Einbindung in den Instanzenzug einer weitgehenden Tatsachenkontrolle entgegenstehen.; Dissertationsschrift 290 pp. Deutsch.…
