Ausschlaggebend dafür ist der Bereich der Behandlung 'lege artis'. Dazu gehören zudem die Themen der Patientenaufklärung und -information, die Einwilligung des Patienten in die Behandlung sowie die Behandlungsdokumentation und das Einsichtsrecht in die Patientenakte.Der Zielsetzung unterstellt, soll zunächst überprüft werden, welche Parallelen zwischen der haftungsrechtlichen Betrachtung der Veterinär- und Humanmedizin bestehen. Daran anschließend wird analysiert, inwieweit die Rechtsprechung bereits gesetzliche Regelungen zur Humanmedizin im Bereich der Veterinärmedizin anwendet. Nachfolgend soll ausgeführt werden, inwieweit die Regelungen des BGB im Zuge der Einführung des PatRG auf die Veterinärmedizin anwendbar sind. Dieser Vergleich findet im Punkt III in Form einer Zusammenfassung der Ergebnisse seinen Abschluss.Dieser Vergleich wurde gewählt, da sich der BGH 2016 in seinem Urteil zur Umkehr der Beweislast bei grobem Behandlungsfehler eines Tierarztes auf die humanmedizinisch-rechtlichen Regelungen bezieht und diese teilweise auch analog anwendet. In diesem Urteil wird immer wieder betont, dass es für die pauschale analoge Anwendung der kodifizierten Rechtsprechung an einer Regelungslücke fehle, dennoch legt dieses Urteil fest, dass, nach Prüfung des Einzelfalls, für den konkreten tierärztlichen Behandlungsvertrag die630a ff BGB Anwendung finden dürfen.
