Als reines Kreationsorgan habe es bei seiner einzigen Funktion - der Wahl des Bundespräsidenten gemäß Art. 54 GG - die besondere Würde des Amtes zu unterstreichen. Als ein eigentümlicher, demokratisch veredelter Rückgriff auf das Erbe der konstitutionellen Monarchie sei diese Wahl alles in allem eine Kür.Diese These kann verfassungsgeschichtlich nicht gestützt werden, vielmehr zeigen sich auch markante Parallelen zu einem Parlament. Die staatsrechtliche Analyse spricht in der Gesamtschau für eine Charakterisierung als »Organ mixtum compositum«. Als solches vereinigt das oberste Bundesorgan parlaments- und kürähnliche Elemente.
