In dieser rechtsvergleichenden Untersuchung befasst sich die Verfasserin vor allem mit grundlegenden Gemeinsamkeiten und Unterschieden des TOA in Deutschland und in Südkorea und deren Bedeutung für die Praxis. Auch die historischen…Hintergründe und Auswirkungen dieses Instituts werden berücksichtigt. Als wichtigste Vergleichspunkte sind dabei der Anwendungsbereich, die Rechtsfolgen nach erfolgreichem TOA, der Umgang mit personenbezogenen Informationen, der TOA in der Jugendstrafrechtspflege zu nennen. Der deutsche TOA findet im Erwachsenenstrafrecht als vertypter Strafmilderungsfaktor im Bereich der Strafzumessung in § 46a StGB und als Auflage bei der vorläufigen Einstellung des Verfahrens gem. 153a Abs.1 Nr. 5 StPO Anwendung. Es ist jedoch zu beachten, dass die Anwendung des § 46a StGB in der Praxis - trotz dieser hinreichenden Unterstützung aus rechtstechnischer und rechtstheoretischer Sicht - ein Schattendasein fristet. Der TOA ist in der deutschen Jugendstrafrechtspflege nicht nur als Weisung gem. § 10 Abs. 1 S. 3 Nr. 7 JGG, sondern auch als erzieherische MaÃnahme im Rahmen einer Einstellung des Verfahrens durch die Staatsanwaltschaft gem. § 45 Abs. 2 S. 2 JGG verankert. Hingegen hat der Gesetzgeber in Südkorea mit dem Opferschutzgesetz in der Fassung v. 14.5.2010 eine gesetzliche Grundlage für den TOA gestellt. Gem. § 46 RV des Präsidenten i. V. m. § 41 Abs. 2 Opferschutzgesetz ist die Anwendbarkeit des TOA - wortgleich in Anlehnung an § 3 Abs. 1 VV zur Handhabung des TOA auf die ausdrücklich genannten Deliktsgruppen wie etwa Vermà gensdelikte, Antragsdelikte wegen bürgerlicher Konflikte, Antragsdelikte usw. begrenzt. Grund dafür ist die Zielsetzung des koreanischen TOA-Modells, d. h. der TOA soll eine effektive Reaktion gegen Antragsdelikten, die zur Entlastung der Strafverfolgungsorgane dient, sein. Zusammenfassend ist der Vergleich präzise und bietet dem Leser reichhaltige Informationen. Die Verfasserin gibt weiterhin nicht nur einen Reformvorschlag für die Verbesserung des koreanischen TOA, sondern fà rdert auch ein kritisches Bewusstsein gegenüber der Euphorie für den deutschen TOA.
