Ahora bien, el juez y el…legislador deberían saber lo que constituye un castigo justo y lo que es una ley justa; el patrono debería saber lo que es un salario justo; la humanidad de hoy debería saber si el orden económico justo es el comunismo o el capitalismo, si la forma justa de Estado es la dictadura o la democracia, si el Estado justo es el liberal o el totalitario. Para cualquiera que desee ser cristiano gravita sobre su conciencia la pregunta de si es justa o no la renta, el lucro sin trabajo. ¿Dónde se conseguirá la medida para contestar estas preguntas, si es que no se conoce el principio de la justicia La humanidad de hoy no lo conoce, pero la cristiandad podría conocerlo. Mientras que la Iglesia Católica, a través de una secular tradición creadora, posee un imponente sistema doctrinal de la justicia, en cambio el Protestantismo, desde hace más de trecientos años, ya no tiene tal doctrina. Esta afirmación puede parecer osada. Pero, por desgracia, es comprobable. Sin duda hay una razón fundamental por la cual la Iglesia Protestante es tan insegura en su actitud respecto de los problemas de la estructuración social, de la economía, del derecho, del Estado y del derecho internacional; y por lo cual sus manifestaciones sobre estas cosas frecuentemente tienen el carácter de improvisaciones casuales, y carecen de fuerza de convicción.Debo manifestar que el fin de este libro no es primariamente de un puro carácter científico, sino de índole práctica, como deben ser todos los trabajos teológicos. No le importa tanto la especulación, cuanto más bien la realización. Ahora bien, reconozco que a toda realización que tenga sentido debe preceder una labor de conocimiento. Con un conocimiento de lo justo, claro y sólidamente fundado, ya se consigue algo para la realización de la justicia, y ciertamente algo que es indispensable. Mis circunstancias presentes -el rectorado de la Universidad de Zúrich- ciertamente no me habrían permitido trabajar en este libro, pero, ¿qué puede uno hacer en contra de las circunstancias, cuando siente uno que tiene que escribir ¿Y quién podría negar que esta es precisamente la época culminante para que quien tenga algo que decir sobre el tema de la justicia lo manifieste Heinrich E. Brunner.

Al Derecho alemán da nombre todo un pueblo que ha carecido siempre de una cohesión rígida, incluso en el tie…mpo que encontró unidad jurídica estatal en el marco del Sacro Romano Imperio. Ello implica, desde luego, un profundo contraste en la historia de ambos derechos. En Alemania mira a los supuestos previos de la formación del Derecho romano, concluida en forma artística y homogénea. El desarrollo del Derecho alemán carece de un punto de cristalización como el encontrado por el Derecho romano en la urbs. Está abandonado por completo a sus fuerzas. Un soberano alemán nunca ha tenido un influjo tan duradero en la producción del derecho como el ejercido por el Papa, en cuanto cabeza de una jerarquía de firme estructura, mediante sus Decretales, en la formación del Derecho canónico.En vano buscaremos en la historia del Derecho alemán un período en que la administración de la justicia se hubiese centralizado en manos de una monarquía absoluta y de un cuerpo de juristas dependientes de ella, tal como fue el caso en Inglaterra bajo los reyes normandos. Hasta la fundación del nuevo Imperio alemán falta la capacidad o la posibilidad de crear un Derecho unitario por vía legislativa como el que recibió Francia desde Luis XIV por las Ordenanzas reales y después con Napoleón I por sus codificaciones. La precitada carencia de órganos capaces para una formación homogénea del Derecho, trae aparejada la consideración de que el Derecho alemán no estaba destinado a completar por sí mismo su desarrollo. Por un tiempo en el que aún no había sobrepasado su período juvenil, a fines del siglo XV, tuvo lugar en Alemania la recepción del Derecho extranjero, sobre todo Derecho romano, Derecho canónico y Derecho feudal lombardo. Este importantísimo acontecimiento justifica la división primaria de la historia del Derecho alemán en dos grandes momentos: el período de la formación del Derecho nacional y el período del predominio del Derecho extranjero.Heinrich Brunner.
