Da tempo appare chiaro che l'essenza del delitto di violenza sessuale risiede nell'imposizione di un atto sessuale non voluto. Disciplinare il reato significa dunque guardare nell'intimità dei protagonisti, ricostruirne le reciproche volontà, interpretarne le azioni e stabilirne gli effetti comunicativi. Per secoli, il diritto penale ha sciolto questo enigma affidandosi all'elemento della violenza, indice sicuro della coercizione e della sua colpevole consapevolezza, dando vita ad una fattispecie "iconograficamente perfetta". Sulla scorta dei significativi mutamenti del costume sociale degli ultimi decenni, tuttavia, non risulta difficile porre l'accento su casi di compressione dell'autodeterminazione sessuale che prescindano dall'utilizzo della violenza fisica, ad esempio sulla base di dinamiche asimmetriche di potere, contesti implicitamente coartanti o incomprensioni sul piano dello sviluppo dell'interazione intima. È così che il diritto penale moderno si trova ad interrogarsi sulla opportunità di riformulare il delitto sostituendo all'elemento della violenza quello dell'assenza di consenso. L'indagine realizzata nel libro si propone di offrire un contributo in questa prospettiva, da una parte sottolineando l'anacronismo di uno dei dogmi più longevi del diritto penale, dall'altra ricercando una soluzione alternativa equilibrata e rispettosa del principio di colpevolezza. L'analisi dapprima si addentra in una dimensione storica, utile a rintracciare i profondi legami tra la tipizzazione tradizionale e il retaggio culturale di epoche lontane, al quale fanno da corollario stereotipi consolidatisi già nella mitologia greca. Nella seconda parte, l'opera ricostruisce lo stato del diritto vivente, per mapparne le lacune nella tutela dell'autodeterminazione e le tensioni con il principio di legalità. Infine, l'indagine si sviluppa concentrandosi sui paradigmi di incriminazione del "rape" ("stupro") nei sistemi giuridici angloamericani, proponendo una trattazione comparata dell'evoluzione della disciplina del delitto e della dialettica tra i differenti modelli del "no means no", adottato anche in Germania, del consenso affermativo (o "yes means yes") e dell'errore colposo sul consenso introdotto in Inghilterra.
