See his entry, and those of his brother and the recipient, in the Oxford DNB. 3pp, 4to. Bifolium. The letter had been torn in half, with loss of a strip of paper from the second leaf, resulting in damage to a couple of words from the valediction; it has been carefully repaired with archival tape, and is otherwise in fair conditi…on, lightly aged, with slight fading of the ink on the first page. The large signature 'James Smith' is clear and undamaged. Addressed to 'J. W. Croker Esq'. An interesting letter, casting light on the workings of the Georgian civil service. At the time of writing Croker was Secretary to the Admiralty. The first paragraph reads: 'My dear Croker / The Appointment of Sir Giffin Wilson to a Mastership in Chancery has occasioned a Vacancy in the Office of Solicitor to the Board of Ordnance: so called although its duties are those of a Barrister. Sargeant Adair hed that office formerly and it was the custom of the Board, up to his period, to obtain the Reports of the Solicitor, as their Counsel, through the information of their Assistant Solicitor. My father was at this Time the Assistant Solicitor: and from the difficulty of obtaining the Sergeants Reports in Time, the Board adopted the Practice of being content with those of my father, as their Assistant Solicitor: afterwards of my father & self as joint Assistant Solicitors, and now of myself singly. This practice has prevailed for upwards of thirty years.' In the second half of the letter he continues his explanation of the various situations of solicitor and assistant solicitor, before asking Croker if he could use his influence to push for a merger of the two posts: 'I need not say that I should feel gratified and obliged.' His father failed in a similar application twenty-five years before, as a member of parliament had to hold the office of solicitor. 'Latterly, however, you are aware that Sir G. Wilson was not in Parliament.' It is not clear whether Croker intervened, or whether Smith's application was went any further.

The volume documents the entire case, including: The opening arguments presented by the Honorable Rufus Choate, which focused on the constitutional tenure of the office of Justice of the Peace and defended the public character and services of Mr. Carter; The answer and defense provided by James G. Carter in response to the specific allegations made by the petitioners; The closing arguments delivered by the Honorable Pliny Merrick, which addressed the petitioners' allegations and the evidence they provided. The final report of the Joint Special Committee, which recommended that the petitioners be given "leave to withdraw their petition," effectively dismissing the attempt to remove Carter from office. 18 pages used, 4to, copies on flimsy paper of outgoing letters signed "James Nisbet & Co.", poor condition, front cover detached, one page detached and damaged, otherwise text complete and legible. Correspondents include a number of Reverends, inc. foreign. Subjects: (1850) They tell author ("Lecture") that his work will be in a…n edition of 3000 and that he has a large credit balance with them, anticipating how much profit he will make on "each succeeding thousand" (£25), the price. "It is a very handsome volume and, in fact, does the publishers no discredit"; a meeting of a Mr Turner's creditors; price levels and the need to reduce to sell; negotiations; creditors in "Mr Cork's affair"; their "claim against the Rev. A.J. Hudson"; tardy acceptance of an order (South African customer); acknowledgment of payment; prices of bibles influenced by the bindings - he lists examples including "Royal Folio Bible Dble pica Type with [Apoc?] at 5gns"; arrangement of dispatch of periodicals (reporting the "North American as out of print", the Galignani to be sent directly from Paris); discussion of "gratuitous help" in the formation of a correspondent's library; they offer to reduce a debt greatly to help a customer who has experienced a serious loss; [corresondent not identified but same as first copy letter above] they cannot accurately state printing costs without the manuscript, but give a detailed estimate: "Supposing the work to be similar to yr second series of Lectures we should say in round [underlined] figures the cost of 1000 copies wd be about £100 - leaving £10 or £11 to cover the expense of correction & advertising". He suggests that the whole edition would make £160 at 5/- ("without deduction for copies for Review &c") but warns him that he should not look for more than £40 profit. He outlines another scenario (1500 copies, expenses of distribution) and concludes with their wish to purchase the copyright and "taking the risk of an edition", and a postscript giving terms (10% for them after trade price considered - "25 or 24 @ 3/7"); they sent a catalogue to [Dr Taylor, Madras] and give terms - order with remittance, discount of 25% over £10, welcoming lsarge export orders for anything but law books; they ask [David D. Scott" to return the MS. "Tetraphonia by Da Costa" with as much of the translation which has ben completed; comment on the Preface to the MS. "God in Disease [to James F. Duncan; published by Nisbet in 1851], saying that the subject is not so much "in [their] department" to offer more favourable terms and want to stick with "half risk and half profit" with the proviso on future editions that they could change the terms. They recommend it be printed "any where but in Dublin" (Duncan's home city); (1859) [To Patrick Beaton re. "Creole and Coolies; or, Five Years in Mauritius" (pub. 1859; reprinted 1971) they make points in response to complaints, firstly that they did not print more than 500 copies but "to place the matter beyond all controversy" they have written to the printer. Secondly, a second edition would be expensive for various reasons (inc. engraving the vignette, charging for corrections), Thirdly, they discuss an error with a section of his MS.apologetically and ask to be informed of any other changes; [also to Patrick Beaton]; they are sending payment for the "[retranslation?] of thirty seven pages of MSS of a German Work". One copy letter is signed "James [Batton?]" indicating the writer of all.

Historically significant collection of eleven original rare manuscripts, providing a valuable insight into the process of preparation of a British advance to the western Kingdom of Nepal in December 1815 in the course of the Anglo-Nepalese War of 1814-1816. Caused by the rapid expansion of the Kingdom of Nepal in the 18th - early 19th centuries (in particular, the conquest of the princely states of Kumaon and Garhwal bordering the territories of the British East India Company), the war consisted of two campaigns. The first one culminated in the capture of the Gorkhali Malaun Fort by Sir David Ochterlony in May 1815, which led to the withdrawal of Nepalese troops to the territory east of the Kali River, leaving Gahrwal and Kumaon to British India (both are now parts of the Uttarakhand state of India). A peace treaty was signed "at Segowlie on the 28th November 1815, and was ratified by [British] Government with the usual salute, on the 9th December. <…> Under the impression that peace was restored, the preparations for the second campaign were suspended, and the commissariat officers, in their zeal for economy, went beyond the bounds of due discretions, discharging great part of the transport establishment and selling much of the grain collected in the frontier depot" (Frontier and Overseas Expeditions from India. Vol. IV. North and North-Eastern Frontier Tribes. Simla, 1907, p. 25; see more ). Nevertheless, during December 1815, it was discovered that the Nepalese government had not ratified the treaty, and the second campaign started south of Kathmandu in January 1816 with the decisive British victory near Makwanpur in March. According to the peace treaty of Sugauli, Nepal ceded roughly one-third of its territory, including Kumaon, Gahrwal and parts of the Terai; a permanent British representative (Resident) was stationed in Kathmandu (Edward Gardner, two of his letters are in this collection); and Nepalese troops, known as Gurkhas, started to serve in the British Indian army, where they were regarded as some of the finest and fiercest soldiers. The documents from the collection date back to November-December 1815, the time of the first signing of the peace treaty and the subsequent discovery by the British that the Nepalese government intended to continue military actions. All manuscripts are related to the organization of the British military force, which was being formed in Sitapur (now Uttar Pradesh state of India) under the command of Colonel Jasper Nicolls (future Commander-in-Chief of the Madras Army and Commander-in-Chief, India), with the goal "to penetrate into the provinces of Doti and Salena" in western Nepal (Frontier and Overseas Expeditions from India. Vol. IV, p. 32). Ultimately, Nicolls' force didn't take part in the military actions, as a quick, victorious campaign by Major General David Ochterlony south of Kathmandu effectively ended the war. The documents contain valuable information on the history of operations of the British Indian Army in Kumaon and along the border of western Nepal.
