Situé sur l'île de la Cité, le Palais de Justice fut le siège du pouvoir politique et administratif des rois de France du Ve au XIVe siècle. Modifié à de nombreuses reprises à l'époque moderne, notamment suite à plusieurs incendies, le bâtiment prend une nouvelle dimension politique sous la Restauration. En effet, sous Louis XVIII et Charles X, le débat judiciaire dispute la préférence au débat parlementaire, si bien que les locaux ne suffisent plus à accueillir le volume croissant des affaire judiciaires. Sont alors entrepris des travaux de restauration, puis, sous la Monarchie de Juillet, un vaste programme d'agrandissement, confié à Jean-Nicolas Huyot, est lancé. L'architecte de l'Arc de Triomphe de l'Etoile est chargé de faire du nouveau Palais un édifice majestueux permettant de recevoir tous les services judiciaires ainsi que la Préfecture de police. Le projet est accepté et sanctionné par l'ordonnance royale du 26 mai 1840. La Révolution de 1848 et la mort de Huyot retardent les travaux, qui reprennent durant le Second Empire sous la direction de Joseph-Louis Duc et Étienne-Théodore Dommey. Dommey et Duc présentent en 1852 un projet pour la nouvelle façade donnant accès à la cour d'assises. En 1867, l'architecte Honoré Daumet devient l'adjoint de Duc pour la construction de la façade occidentale du Palais de justice donnant sur la place Dauphine en 1867. Une fois encore, le Palais de justice est victime d'un incendie à la fin de la Commune de Paris, lors de la Semaine Sanglante : dans la nuit du 24 mai 1871, une grande partie du monument terminée deux ans auparavant est détruite (dont le tribunal de première instance, la police correctionnelle, les bureaux de l'État civil, les archives, le parquet général, le parquet du Procureur de la République, les cabinets des juges d'instruction, les deux salles des cours d'assises achevées, une grande partie de la Cour de cassation, la cour d'appel, etc.). Les travaux ne s'achèveront qu'en 1875.
