Die Tür zum Beratungszimmer hat sich indes einen Spalt weit geöffnet, als 1970 den Richtern des Bundesverfassungsgerichts das Recht eingeräumt wurde, ihre abweichende Meinung zu der Entscheidung in einem Sondervotum zu veröffentlichen. Während dieses Instrument den meisten Landesverfassungsgerichten der alten Bundesländer unbekannt blieb, entschieden sich Berlin und die neuen Bundesländer - mit Ausnahme des Freistaates Sachsen - bei der Errichtung ihrer Landesverfassungsgerichtsbarkeit dafür, es ebenfalls in ihre Verfahrensbestimmungen aufzunehmen.Die nunmehr rund zehnjährige Rechtsprechungspraxis der Landesverfassungsgerichte gibt Anlass, die Erfahrungen mit dem Sondervotum speziell bei diesen Gerichten zu untersuchen.
