Paperback. Condizione: New. Print on Demand. This book critically evaluates the popular legal dogma that an obligation is void if its performance is impossible. This idea is often traced back to the Roman legal concept of impossibilium nulla obligatioâ"literally, there is no obligation for impossibilitiesâ"which has been interpreted to mean that an impossible contract is null and void. The author argues that this interpretation is based on a misunderstanding of Roman law and that, in fact, Roman law allowed for the validity of contracts even when performance was impossible. The author also explores the historical development of the impossibility doctrine, showing how it has been shaped by philosophical and social factors over time. The author concludes by arguing that the impossibility doctrine is outdated and that it should be replaced by a more flexible approach that takes into account the specific circumstances of each case. This book is a valuable resource for anyone interested in the history and philosophy of law. It offers a fresh perspective on a long-standing legal doctrine and provides a new way of thinking about the relationship between obligation and performance. This book is a reproduction of an important historical work, digitally reconstructed using state-of-the-art technology to preserve the original format. In rare cases, an imperfection in the original, such as a blemish or missing page, may be replicated in the book. print-on-demand item.…
