Dabei entwickelte sich die Dogmatik der Stellvertretung an derjenigen im…Besitzerwerb. Es verwundert um so mehr, daß für das geltende Recht eine Stellvertretung im Besitz einhellig abgelehnt wird.Die Pandektenwissenschaft schuf nach dem Vorbild des klassischen römischen Rechts die Grundlagen der modernen Rechtsdogmatik. Gegenstand der Arbeit ist es, diese historischen Grundlagen neu herauszuarbeiten und so für eine moderne Dogmatik der Stellvertretung im Besitz fruchtbar zu machen. Über die teils in Vergessenheit geratenen Erkenntnisse der Spätpandektistik hinausgehend, werden hierzu die klassischen Quellen, auf denen sie fußen, dargestellt und untersucht.Dabei zeigt sich, daß das klassische Recht einen Besitzerwerb durch Dritte in drei wesensverschiedenen Formen kannte: Durch eine von seiner Rechtsgewalt abhängige Person, einen Sklaven etwa, erwarb der dominus den Besitz wie durch einen verlängerten Arm, wenn er einen Erwerbsauftrag erteilte. Räumte er dem Gewaltabhängigen ein peculium ein, so verselbständigt sich dieses als Zurechnungspunkt des Besitzerwerbs. Gegen Ende der hochklassischen Periode schließlich setzt sich das Rechtsinstitut der freien Stellvertretung im Besitz durch, einer echten Stellvertretung in Sachgewalt und Herrschaftswillen, die Besitz unmittelbar in der Person des Erwerbers schafft, obwohl dieser tatsächlich keine Gewalt über die Sache hat. Eine Ausprägung dessen ist das Besitzkonstitut, während der »Geheißerwerb« sich nicht auf Stellvertretung gründet.; Dissertationsschrift.
